Welcome to Fathom. By downloading, installing, or using the Fathom application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.
These Terms constitute a legally binding agreement between you and Fathom ("we," "us," or "our"). By accessing or using the App, you confirm that you are at least 13 years of age and have the legal capacity to enter into these Terms.
Fathom is a workplace wellness application that provides tools for tracking work patterns, guided breathing exercises, focus timers, reflective journaling, AI-powered insights, and related wellness features. The App is designed as a personal productivity and wellness support tool.
Fathom is not a medical device and does not provide medical advice, diagnosis, or treatment. It is not a substitute for professional medical or mental health care. If you are experiencing a mental health crisis, please contact a qualified healthcare professional or your local emergency services immediately.
Fathom stores your preferences and activity data locally on your device by default. No account creation is required. You are responsible for maintaining the security of your device and any data stored on it.
Optional features such as Analytics and Cloud AI may transmit limited data to third-party services as described in our Privacy Policy. You can enable or disable these features at any time through the App's Settings.
Fathom offers a free tier with core features including journaling, basic insights, daily reminders, and one guided breathing session.
Premium features are available through auto-renewable subscriptions (monthly or yearly) managed via Apple's App Store. Pricing is displayed in the App and may vary by region.
Eligible new subscribers may receive a free trial period (e.g., 7 days) as an introductory offer managed by Apple. The free trial automatically converts to a paid subscription at the end of the trial period unless canceled at least 24 hours before the trial expires. Free trial eligibility is determined by Apple and is typically available once per Apple ID.
New users may also be eligible for a 30-day in-app free preview of premium features. The preview provides full access to Pro features at no charge during the preview period and does not require payment information.
Fathom offers a one-time, non-consumable "Lifetime Access" purchase that grants permanent access to all Pro features. This purchase is non-refundable except as required by applicable law or Apple's refund policies. Lifetime access includes all current and future feature updates.
Subscriptions are billed through your Apple ID account. Payment is charged at confirmation of purchase. Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period.
You can manage or cancel your subscription at any time through your Apple ID settings (Settings → [Your Name] → Subscriptions). Cancellation takes effect at the end of the current billing period. No refunds are provided for partial billing periods. The lifetime purchase is not a subscription and does not require cancellation.
You agree to use the App only for lawful purposes and in accordance with these Terms. You agree not to:
All content, features, and functionality of the App — including but not limited to text, graphics, logos, icons, software, and the overall design — are owned by Workforce Intelligence Group, LLC or its licensors and are protected by copyright, trademark, and other intellectual property laws.
You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes in accordance with these Terms.
Fathom includes AI-powered features such as insight generation, journal summarization, text rewriting, and task breakdowns. These features use on-device processing and, optionally, cloud-based AI services (Google Firebase Vertex AI).
Fathom offers optional geofencing features that use your device's location services. By enabling these features, you consent to the collection and processing of location data as described in our Privacy Policy. You can revoke location permissions at any time through your device's Settings.
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the App will be uninterrupted, error-free, or free of harmful components. We make no representations about the accuracy or reliability of any AI-generated content, insights, or recommendations.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FATHOM AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, PROFITS, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE APP.
Our total liability for any claim arising from or related to the App shall not exceed the amount you paid for the App in the twelve (12) months preceding the claim.
You agree to indemnify, defend, and hold harmless Fathom and its affiliates from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the App or your violation of these Terms.
We may suspend or terminate your access to the App at any time, with or without cause, and with or without notice. Upon termination, your right to use the App ceases immediately. Provisions that by their nature should survive termination shall survive, including but not limited to ownership, warranty disclaimers, and limitations of liability.
We reserve the right to modify these Terms at any time. Updated Terms will be posted on this page with a new effective date. Your continued use of the App after changes constitutes acceptance of the revised Terms.
These Terms shall be governed by and construed in accordance with the laws of the United States and the state in which Fathom is headquartered, without regard to conflict of law principles.
